Charges should be dismissed against a Dunbar Township man accused of drunken driving when he wrecked his truck, killing an Acme woman, because blood tests performed by state police crime labs are unreliable, a defense attorney argued Tuesday.
Sam Davis of Uniontown said it is common practice for state police to destroy blood samples in DUI cases 30 days after testing, but the 1986 court case that permits the practice is outdated.
