MOBILE, Alabama — A candidate for the state school board was arrested last summer on Dauphin Island, charged with speeding and driving under the influence of alcohol. Jessica Sue James, 35, said she was on blood-pressure medication, so she declined to take a breath test to determine what her blood-alcohol level was. As a result, she said her drivers license was suspended for three months. She has pleaded not guilty to the DUI charge. James said she was driving from Mobile to Dauphin Island on July 8, with her vehicle’s cruise control set to 60 miles per hour. At about 10:30 p.m., as she was going over the Gordon Persons Bridge, she approached a line of cars that was going slow, about 35 or 40 miles per hour, she said. So, she passed them. Turns out, the first car was a police officer, who pulled James over for speeding. James said she was not drinking that night. She said she did not know how fast she was driving. The speed limit on the bridge is 55 miles per hour, according to police.

“I was taking blood-pressure medicine at the time, and I had a sprained right ankle,” she said. “I refused the test, so that’s why he gave me the DUI.” She said she didn’t know how the medication would affect the test. She said she showed the police officer her prescription. He searched her car, but didn’t find anything else. The whole thing, she said, “was absolutely ridiculous. It was almost like he had a speed trap set.”

Dauphin Island Police Sgt. Anthony La Frenier, who was not the arresting officer that night, said he could not say much about the case because it has not gone to trial. He said the trial is set for next week.

LaFrenier, an officer for 12 years, would not confirm whether James refused to take the breath test.

When told that she admittedly refused the test because of medicine she was on for high blood pressure, he said: “I’ve never heard of anything but alcohol triggering a blood alcohol breath test reading.”

James said she was driving to her parents’ house on the island. Instead, she was arrested and booked into Mobile County Metro Jail at about 2 a.m. July 9. She was released six hours later on a $1,200 bond, according to jail records. Her license has since been reinstated.

James, a Republican, is running for the state’s District 1 school board seat currently occupied by Randy McKinney, who is not seeking re-election. She faces Republican Tracy Roberts in the March 13 primary.

Roberts said today that she was surprised to hear of the incident when a Press-Register reporter asked her about it. “If it’s true,” she said, “it’s very disappointing.” The district now includes Mobile, Baldwin, Escambia, Butler, Conecuh, Covington and Crenshaw counties. A native of Washington County, James is a contractor in work force development at Bishop State Community College. She formerly worked under Gov. Bob Riley as a coordinator for the Alabama Department of Economic and Community Affairs. James said she does not think this incident should affect how people vote in the school board race. ”I was speeding. I passed those eight cars,” she said. “People get pulled over for speeding every day.”

TUSCALOOSA, Alabama — A man was charged with attempting to elude police and driving under the influence Saturday night after a more than 10-mile chase in Tuscaloosa County, according to a statement released this afternoon by a public information officer with the Tuscaloosa Sheriff’s Office.

Late Saturday night sheriff’s deputies were advised by dispatchers of a vehicle traveling southbound on Interstate 20/59 that did not have its headlights on and was weaving, according to the statement from sheriff’s Sgt. Andy Norris. Norris explained the chase, between 11:08 p.m. and 11:21 p.m., unfolded like this:

An officer with the Vance Police Department spotted the vehicle at the 86 mile marker traveling southbound. The vehicle failed to stop for him and a pursuit ensued.

Deputies joined the pursuit at the 77 mile marker. A Deputy deployed stop sticks at the 71 mile marker, but the suspect exited off the interstate at the McFarland Boulevard exit and continued westbound on McFarland. The man came to a stop at 31st St East and McFarland. Before the driver was taken into custody, he hit a Tuscaloosa Police Department car at a very slow speed causing no damage, according to the statement.

Jeffery Allen Wood, 39, was taken into custody by deputies without any further incident. Wood was transported to the Tuscaloosa County Jail and charged with attempting to elude and DUI, according to Norris’ statement. Bond was set at $6,000.

VIRGINIA BEACH, Va. — A Virginia Beach man who racked up at least 25 arrests for drunken driving in several states has been sentenced to seven years in prison.

WVEC-TV reports that a judge sentenced 39-year-old Tracy Michael Decker on Tuesday. Decker is also banned from driving for 20 years after DUI arrests in Virginia, Alabama and Georgia.

Decker spent more than four years in a Virginia prison after a 2006 arrest on the Chesapeake Bay Bridge Tunnel. His blood alcohol-content was .28, he had an open container and two 4-year-old children who were not in car seats. Decker was released from prison in 2010, but arrested for DUI in Alabama four times within eight months.

His new arrests violated the conditions of his release in Virginia.

CLICK HERE for the full story.

As is clear after reading the above, hiring a DUI attorney is important in every case. In fact, if the defendant above had been involved with any attorney that “thinks outside the box” or provided some alternative suggestions on things he could have done to help himself and prevent further arrests, maybe he would have corrected his alcohol issue and not been subject to 25 arrests and now 7 years in prison. Failure to have adequate guidance and counsel and proper direction will almost certainly result in extreme punishment, especially if it is not your first violation.

ALBUQUERQUE, N.M. (AP) – The drunken driving trial for two-time Indianapolis 500 winner Al Unser begins Monday in Albuquerque. Bernalillo County authorities arrested Unser in September after deputies say he was going more than 100 mph while racing another driver. Authorities say his blood-alcohol content was twice the legal limit. Unser, known in racing circles as ”Little Al,” previously pleaded no contest to a drunken driving charge in 2007 in Las Vegas.
